These Terms of Service (“Terms”) govern your use of the Zen Web Media
website and any services you purchase from us, including website
design, managed hosting, tech support, and API development
(“Services”). By using our website or purchasing Services, you agree
to these Terms.
Who We Are
Zen Web Media (“we,” “us,” “our”) is a San Diego, California based
business providing WordPress web design, managed hosting, AV/tech
support, and API development services.
Our Services
We offer:
- Custom WordPress website design and development
- Managed WordPress hosting with email
- Hourly website design support
- Hourly API development and integration work
- AV systems, networking, and on-site tech support

service’s product page and may be updated from time to time.
Payment Terms
- One-time projects (e.g., website builds) are billed according to
the payment schedule agreed upon at project start — typically a
deposit before work begins, with the balance due at completion or in
milestones as outlined in your project agreement. - Hourly services (Website Design Support, API Development) are
billed based on hours purchased. Work begins once payment is
received. If a project requires more time than initially purchased,
we’ll let you know before continuing so you can purchase additional
hours. - Recurring services (Managed Hosting) are billed monthly or
annually in advance, as selected at checkout, and processed through
our billing system at secure.zenwebmedia.com. - Late or failed payments on recurring services may result in
suspension of hosting or related services until payment is resolved.
Cancellations & Refunds
- Hosting may be canceled at any time; cancellations take effect
at the end of the current billing period. We do not provide
refunds for partial billing periods already in progress. - Hourly services (Design Support, API Development) are refundable
only for unused, unstarted hours. Once work has begun on a given
block of hours, that portion is non-refundable. - Website design projects follow the cancellation and refund terms
specified in your individual project agreement, since these vary by
project scope.
If you have a billing question or dispute, contact us directly at
info@zenwebmedia.com before opening a chargeback — we’re generally
able to resolve issues faster that way.
Your Responsibilities
When using our Services, you agree to:
- Provide accurate account and contact information
- Keep any login credentials we provide you secure
- Use our Services and your hosted website lawfully, and not to
distribute malware, spam, or illegal content - Maintain ownership or proper licensing for any content, images, or
materials you provide us to use on your website
We reserve the right to suspend or terminate service for accounts used
in violation of these terms, including illegal activity, abuse of
server resources, or non-payment.
Intellectual Property
- Your content (text, images, logos, and other materials you
provide) remains your property. You grant us permission to use it
solely for the purpose of building, hosting, and maintaining your
website. - Our work product — custom code, designs, and configurations we
build for you — becomes your property upon full payment for the
applicable project, unless otherwise agreed in writing. Third-party
themes, plugins, and licensed assets remain subject to their own
license terms. - We may, unless you request otherwise, reference completed projects
in our portfolio for marketing purposes.
Hosting & Service Availability
We aim to keep hosted websites available and performing well, and we
perform regular monitoring, updates, and backups as described on our
Hosting and Web Security pages. However, we do not guarantee
uninterrupted, error-free service — occasional downtime for
maintenance, updates, or circumstances outside our control (e.g.,
third-party outages, force majeure events) may occur.
Limitation of Liability
To the fullest extent permitted by law, Zen Web Media is not liable
for indirect, incidental, or consequential damages arising from your
use of our Services, including lost profits, lost data, or business
interruption — except where such damages result from our gross
negligence or willful misconduct. Our total liability for any claim
related to our Services is limited to the amount you paid us for the
Service giving rise to the claim in the preceding 12 months.
Third-Party Services
Our Services may involve or link to third-party tools, platforms, or
services (e.g., domain registrars, plugin developers, payment
processors). We are not responsible for the practices, availability,
or terms of those third parties.
Changes to These Terms
We may update these Terms from time to time. Material changes will be
posted here with an updated effective date. Continued use of our
Services after changes take effect constitutes acceptance of the
updated Terms.
Governing Law
These Terms are governed by the laws of the State of California,
without regard to conflict-of-law principles.
